1. Terms of Service

1.1. These Terms of Service together with our Privacy Policy form the entire Agreement between our company Intercontinental Care OÜ (hereinafter referred to as “ICC”, “Intercontinental Care”, “Company”, “We”, “Us”, “Our”) and you as our client (hereinafter referred to as “You”, “Your”, “User”).
1.2. This Agreement governs the use of Our company’s website www.interconcare.com (the “Website”) and Services rendered by Intercontinental Care (the “Service” or “Services”).
1.3. By using the Website and/or requesting our Services you agree with the terms set out in this Agreement and you will apply your best efforts in order to comply with these Terms. In the event you disagree with this Agreement in full or any portion of it, please immediately stop using the Website and/or our Services.
1.4. Intercontinental Care reserves the right to make changes to the Terms of the Agreement with or without prior notification to you. It is your sole responsibility to periodically check for any changes or updates to the Agreement. If you do not agree with the new updated version of the Agreement please stop using the Website and/or our Services.
1.5. In order to use the Website and/or the Services you must be at least 18 years old age. If you are a minor stop using the Website and/or our Services and ask your parents or legal guardian to request our Services on your behalf.

2. Services

2.1. Intercontinental Care is a consulting company that provides information about medical services and healthcare providers around the world to the Users of its Website. By using the Website and/or our Services you will be provided with a range of medical service providers based on your specific request, including but not limited to hospitals, clinics, medical resorts, medical spas, rehabilitation centers, etc. (hereinafter referred to as “Providers”).
2.2. ICC provides a list and description of the services of the most suitable Providers based on the specific needs of each User (e.g. language, country, medical condition, etc.). The User can then decide if he wishes to make an appointment with one of these Providers or request additional information.
2.3. The information regarding the Providers that is available on the Website and was received from the Providers themselves or was created based on the  information from the Providers’ websites. We do our best to make sure that such information is accurate and up-to-date. However, Intercontinental Care cannot guarantee and cannot be held responsible for the accuracy and preciseness of such information. Intercontinental Care will not be liable for failure to provide accurate information from a Provider, nor shall the Website be regarded as a representation, recommendation, guarantee or endorsement of the service quality and the specialization of any Provider.
2.4. Intercontinental Care is not a medical service provider, but an intermediary between the User and the Provider. Therefore, any information provided on the Website and/or through the Service including, but not limited to, the information provided by the Providers or any other third-party, cannot be viewed as a proper medical consultation or medical examination and cannot be used on its own to decide whether to proceed with a medical treatment or to terminate it.
2.5. Some pharmaceutical products displayed on our website require a doctor’s prescription for their correct use while others may be forbidden in certain countries. It is your sole responsibility to make sure that you comply with your doctors recommendations and with the laws of the country where you live.

3. Payment

3.1. Users of our Website do not have to pay for the consulting Services provided by Intercontinental Care.
3.2. Payment is done only and directly to the Provider chosen by the User for the services that will be or that already were provided by the Provider.
3.3. Intercontinental Care does not sell or share the personal information of its Users with third parties for advertisment purposes

4. Medical Assessments

4.1. Our Service includes an evaluation of User’s past and present conditions, analysis of his medical history, preparation of treatment plans and price quotations by the Providers, follow-up and assistance in comparing various offers.
4.2. In order to obtain the best results, we recommend that the User first receive primary care from a local medical specialist before proceeding to the use of the Intercontinental Care’s Website and Services. This ensures that the User has a better understanding of the type of treatment he requires as well as the necessary exams and medical images that we will be examined by the Providers.
4.3. By requesting a Service the User agrees and accepts that:

      • The initial assessment received will be limited and provisional;
      • The initial assessment is not considered nor aimed to replace a full medical evaluation or an in-person visit to a physician;
      • The medical specialists who are providing services through the Website do not possess crucial information which is usually gathered through an in-person examination;
      • The absence of an in-person examination may affect the medical specialist’s ability to diagnose your condition, disease or injury.

4.4. The User agrees that the medical assessment carried out by Intercontinental Care will not be used in any kind of legal proceedings including, but not limited to, legal disputes, litigation, arbitration, claim for disability benefits etc.

4.5. The User can provide medical records on behalf of another person, but only if User provides prior notification to Intercontinental Care that:

      • The person is the User’s family member;
      • The User received a prior consent from that person to represent him;
      • The person is not able to send a request via Website by himself.

4.6. In order to receive any kind of Services from Intercontinental Care, the User shall provide current and accurate identification, contact and any other relevant information required to verify User’s identity. It is within User’s sole responsibility to maintain the accuracy and completeness of this information. By providing such information the Users guarantees that the information is true and accurate.
4.7. Intercontinental Care will collect the complete medical records needed and afterward will create a Medical Case. In accordance to the information provided, Intercontinental Care will match User’s medical case with up to 3 (three) different Medical Specialists in Intercontinental Care’s network of Providers or outside of it if the complexity of the case requires it. These Medical Specialists will receive the documentation from Intercontinental Care and create a treatment plan. The Providers will then send the treatment plans and price quotations to Intercontinental Care which will forward it to the User. The User which will have the right to choose which Medical Specialist and Provider will provide the treatment.

5. Limitation of Liability

5.1. Other than as expressly set out in these terms or additional terms, Intercontinental Care does not make any promises or quality declaration about the services rendered by it and does not provide any guarantees regarding those services.
5.2. By using the Website its Services you explicitly confirm that you understand and take responsibility and assume all risks, direct or indirect, resulting from the use of the Website without limitations.
5.3. Intercontinental Care and its employees, management, partners, shareholders, and agents do not bear any responsibility for failures of any kind or shutdown of the Website resulting in loss of business information, profit or other financial losses due to claims of any kind, losses, petitions, actions or other events occurring due to validity of these terms of use, including without limitations the website navigation, use, access to any files or their parts.
5.4. Intercontinental Care bears no liability for the correctness, completion and up-to-dateness of any information provided by Providers and/or any other third-parties on the Website.
5.5. There may be links to third-party websites on this website. Such links are provided solely for the convenience of the User. Intercontinental Care shall not bear any liability in case of any damages or losses, direct or indirect, due to a visitation originating from Intercontinental Care, or to the use of services from third-party websites.
5.6. Moreover, consenting to the terms of this agreement, the User agrees to indemnify, defend and hold Intercontinental Care, its affiliates and their respective directors, officers, employees, shareholders, partners and agents (collectively, the “Intercontinental Care Parties”) harmless from and against all claims, liability, losses, damages, costs and expenses (including reasonable legal fees) incurred by any Intercontinental Care party as a result of, or in connection with, any breach or alleged breach by the User or anyone acting on the User’s behalf of any of the terms of this Agreement.

6. Data Protection

6.1. In order to receive complete Website functionality and get access to all of the Website’s features, you are required to provide certain private information including, but not limited to, personal, specific and sensitive information.
6.2. We respect the confidentiality of private and personal information of all cooperating parties. However, there is no perfect secure method of protecting information during its storage, processing, and transfer into electronic form. We do not give the full warranty of its complete safety, despite all efforts made by Intercontinental Care.
6.3. The User confirms that he has read our Privacy Policy before requesting our Services. For more information about the procedure of collection, use, and/or disclosure of the User’s confidential information, please read the  Privacy Policy.

7. Intellectual Property

7.1. All of the Website assets, including the system of organization and presentation of the materials at the Website, are the property of Intercontinental Care. These materials include but are not limited to, the design, layout, look appearance and graphics. Website and its materials are protected by laws and regulations relating to intellectual property including but not limited to copyright laws and other similar laws.

7.2. Unconditioned use and reproduction of the materials presented at the Website without the written permission of Intercontinental Care is prohibited.
7.3. You may only use the Website (including all the related materials to it) for your personal and non-commercial use. It is forbidden to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of Intercontinental Care materials. When using any information from Intercontinental Care site, active link referring to the source is mandatory.

8. Website Updates

8.1. We regularly update technical, content and other information on the Website. 8.2. We make no claim in guaranteeing the completeness, accuracy, and compliance of the information provided at the Website. We may at any time add, review or delete information, languages, guides and services posted on the Website.

9. Computer Viruses

9.1. At times, Website failures may happen due to an Internet connection, software operation, data transmission, etc., and it is possible that incorrect or incomplete copy of the information contained at the Website pages may occur. Similarly, the Website pages may contain malicious code or programs infected with computer viruses. We are not responsible and bears no liabilities connected to the work of any software, the presence of any computer viruses or other elements with malicious code, the presence of destructive or unsafe files that can be distributed or otherwise affect software and hardware upon the User’s browsing of the Website, the access to any information on the Website, or the downloading of any files from the Website. Intercontinental Care does not purposely distribute any kinds of viruses, however the we do strongly encourage the use of anti-virus software or other protective programs during interaction with all websites on the internet.

10. Force Majeure

10.1. In no event shall Intercontinental Care be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services.

11. Applicable Law

11.1. The validity, interpretation, and enforcement of this Terms of Use, matters arising out of or related to performance or breach of this Terms of Use, and related matters shall be governed by the laws of Estonia.

11.2. Any legal action or proceeding concerning the validity, interpretation, and enforcement of this Terms of Use, matters arising out of and/or related to performance or breach of this Terms of Use, and related matters, shall be resolved by negotiations.

11.3. In case it is impossible to reach common solution through negotiations all disputes shall be brought exclusively in courts located in Estonia. All parties consent to the exclusive jurisdiction of those courts, waiving any objection to the propriety or convenience of such venues.

12. Severability

12.1. Any provision of these Terms of Service that is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition without invalidating the remaining provisions hereof, and any such prohibition in a particular jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.

13. Assignment

The User may not assign or transfer any of User’s rights or obligations under these Terms of Service without Company’s prior written consent. Intercontinental Care may assign or transfer any or all of the company’s rights under these Terms of Service, in whole or in part, without obtaining User’s prior consent or approval.

14. Waiver

14.1. The failure or delay by Intercontinental Care to exercise any right, power or privilege under these Terms shall not operate as a waiver thereof.

15. Headings

15.1. Headings of provisions are for convenience only and shall not be used to limit or construe any provisions of these Terms thereof.

16. Translations

16.1. The original, legally binding version of this document is written in English, and it is translated into other languages for the convenience of its non-English-speaking Users. If there are any discrepancies between the English version and a translated version, the English version will be considered as valid instead of the translated version.
